Propbase (propbase.in)
(“Propbase”, “we”, “us”)
These Terms of Service (“Terms”) govern your use of the Propbase mobile application, the propbase.in website, and related services (the “Platform”). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy (propbase.in/privacy), which forms part of these Terms.
1. What Propbase Is (and Is Not)
Propbase is a technology platform that enables real estate professionals — brokers, property owners, builders and developers — to list properties, post requirements, discover inventory, and connect with each other.
Propbase is not a party to any transaction between users. We do not act as your real estate agent, do not represent buyers or sellers in user-to-user dealings, do not handle transaction funds, and do not charge brokerage on deals you conclude with other users. All negotiations, agreements, site visits, payments, commissions and transactions between users are solely between those users. Any separate commercial arrangement Propbase may have with a builder or developer (such as registered channel-partner arrangements) will be governed by separate written agreements and does not make Propbase a party to your transactions.
2. Eligibility and Accounts
- You must be at least 18 years old and using the Platform for professional/business purposes.
- Accounts are created by verifying your mobile number via OTP. You are responsible for activity under your number and for keeping your information accurate.
- One account per person. You may not impersonate others or misrepresent your role, firm or authority to deal in a property.
- We may suspend or terminate accounts that violate these Terms.
3. Listings and Requirements — Your Responsibilities
When you post a listing or requirement, you represent and warrant that:
- The information is accurate, current and not misleading (including price, availability, area and possession status);
- You have the right or authority to offer the property or post the requirement (as owner, or as a broker with a valid mandate or the owner’s consent);
- The content complies with applicable law, including RERA and local regulations where applicable;
- You will promptly mark listings as sold, rented or inactive when no longer available, and respond honestly to availability-verification prompts.
You retain ownership of content you submit. You grant Propbase a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt and distribute your listings, requirements and related content on and off the Platform for operating and promoting the Platform — including in search results, share graphics, public listing pages, and previews on third-party services (e.g., WhatsApp link previews).
We may verify, edit for format, decline, deactivate or remove any content at our discretion, including stale, duplicate, suspected-inaccurate or non-compliant content.
4. Community-Sourced Listings
The Platform includes listings aggregated from information that real estate professionals have themselves publicly posted in broker forums, groups and channels (“community listings”). Community listings are labeled as such and are provided as-is: Propbase does not verify them and makes no representation as to their accuracy or current availability. If a community listing carries your contact number, you may claim it for free by verifying your number, or request its removal at any time (privacy@propbase.in or in-app). Claiming a listing makes Section 3 apply to it as if you had posted it.
5. Contacts, Credits and Fair Use
- Contact details of listing/requirement posters are revealed through the Platform’s contact-unlock feature, which is metered (free allowances and/or paid plans, as displayed in the app).
- Contact information obtained through the Platform may be used only for bona fide communication about the relevant property or requirement. Bulk export, resale, sharing outside your firm, marketing lists, or harvesting of contacts or listings is strictly prohibited.
- We log contact reveals and may display to a poster that their contact was viewed, with limited context.
- Current allowances, plans and prices are shown in the app and may change prospectively with notice. Paid subscriptions, when offered, will be governed by the plan terms shown at purchase; fees are non-refundable except as required by law or stated at purchase.
6. Prohibited Conduct
You must not:
- Post false, misleading, duplicate-spam, or unauthorized listings, or listings of properties you have no right to offer;
- Scrape, crawl, copy, frame or systematically extract data, listings or contacts from the Platform, or use bots or automated access without our written permission;
- Circumvent or attempt to circumvent contact gating, usage limits, or security measures;
- Harass, defame or abuse other users, or use contacts for spam;
- Reverse engineer, interfere with, or disrupt the Platform;
- Use the Platform for money laundering, fraud, or any unlawful purpose.
Violations may result in content removal, account termination, forfeiture of credits, and legal action.
7. Intellectual Property
The Platform, including the Propbase name, marks, logos, design, software, databases and compilations (including the structure, selection and arrangement of listing data), is owned by or licensed to us and protected by law. Except for the limited right to use the Platform for its intended professional purpose, no rights are granted to you.
8. Third-Party Services and Content
The Platform may link to or interoperate with third-party services (e.g., WhatsApp, telephony, map services). Your use of those services is governed by their terms. Project and regulatory information displayed from public sources (e.g., RERA records) is provided for convenience; verify with the official source before relying on it.
9. Disclaimers
THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PURPOSE AND NON-INFRINGEMENT. PROPBASE DOES NOT VERIFY USERS, PROPERTIES, TITLES, APPROVALS OR LISTINGS (EXCEPT WHERE A SPECIFIC VERIFICATION BADGE EXPRESSLY STATES WHAT WAS VERIFIED AND WHEN), AND DOES NOT GUARANTEE ANY TRANSACTION, RESPONSE OR OUTCOME. CONDUCT YOUR OWN DUE DILIGENCE — INCLUDING TITLE, RERA STATUS, APPROVALS AND PHYSICAL INSPECTION — BEFORE ANY TRANSACTION.
10. Limitation of Liability
To the maximum extent permitted by law: (a) Propbase shall not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits, business, goodwill or data, arising from or relating to the Platform or dealings between users; and (b) Propbase’s aggregate liability for all claims in any 12-month period shall not exceed the greater of ₹5,000 or the amounts you paid to Propbase in that period. Nothing limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless Propbase and its proprietor, employees and agents from claims, losses and expenses (including reasonable legal fees) arising from your content, your listings, your dealings with other users, or your breach of these Terms or applicable law.
12. Governing Law and Disputes
These Terms are governed by the laws of India. Subject to any mandatory law, courts at New Delhi, India shall have exclusive jurisdiction. Before filing any claim, you agree to first write to us at legal@propbase.in and allow 30 days for good-faith resolution.
13. Changes, Suspension and Termination
We may modify the Platform or these Terms; material changes will be notified in the app or by message, and continued use constitutes acceptance. You may stop using the Platform and delete your account at any time (Profile → Settings → Delete Account or propbase.in/delete-account). Sections that by nature survive termination (including 3, 5–7 and 9–12) survive.
14. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and Propbase regarding the Platform. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer or reorganization (including incorporation of the business into a company).
